Employment Policies and Procedures

Employment Conflicts and Disputes

Employment Investigations of Employee Complaints
Employers who receive an employee complaint, particularly one alleging sexual harassment, have a duty to conduct a fair and impartial investigation of that complaint. For various reasons, including the preservation of the employer's attorney-client privilege with existing counsel, it is often prudent for the employer to hire outside counsel to conduct the investigation and prepare a report advising the employer of its findings. Our attorneys have experience in acting as outside investigators and will quickly and thoroughly investigate complaints, document the evidence and prepare a thorough and complete report for the employer.
Employment for Individuals, Counsel on Severance Agreements and Releases
Where no conflict arises with current clients of the firm, our attorneys also provide representation to employees or groups of employees who are discharged or whose positions are eliminated and have been provided with a proposed Severance Agreement and Release. Most often, the proposed agreement will instruct an employee that he or she has the right to seek the advice of counsel regarding that agreement, but there is generally a very short period of time in which to do so. It is critical to act swiftly to consult an attorney with experience in such matters. We help employees obtain all relevant personnel records, as well as review and evaluate the terms of the agreement and the circumstances of the cessation of employment, in order to properly advise them of their options.
